Litigation Funding vs. Contingency Fees in the UAE
With a contingency or success fee, the lawyer takes part of the risk. With litigation funding, an independent funder pays case costs and is repaid only from a successful outcome, while the claimant keeps their chosen lawyer. Funding can also cover costs a lawyer would not, such as court fees, experts and enforcement.

Key differences
Who carries the risk: a funder carries the cost risk of the case rather than the law firm. What is covered: funding can cover third-party costs such as court fees, experts and translations. Choice of counsel: the claimant keeps their own lawyer.
Working together
Funding is often co-counsel friendly: the law firm runs the case, and the funder provides a milestone-based budget with transparency on costs.
